Thank you for choosing Fortiffi, the platform built to connect businesses, affiliates, and customers through innovative, flexible solutions. By signing up for a Fortiffi account, you are agreeing to be bound by the following Terms of Service. Please read these terms carefully, as they govern your use of the platform and its features.
As used in these Terms of Service, “we,” “us,” and “our” refers to Fortiffi, and “you” refers to the user (whether an individual or a business entity) registering for or using any of our services. Fortiffi provides a comprehensive set of tools for businesses, including customizable storefronts, secure payment systems, booking management, marketing tools, affiliate integration, and much more.
Whether you’re offering products, services, or digital content, Fortiffi is designed to help you manage and grow your business. While we’re starting with a focus on entertainment services, we are expanding our platform to serve businesses in a wide variety of industries, helping you streamline operations, connect with customers, and generate more revenue. In the future, Fortiffi will offer even more tools and features to support different business types, providing opportunities to diversify and scale.
By using Fortiffi, you agree to the Terms of Service outlined here, including our Privacy Policy, Acceptable Use Policy, and any other terms that may apply to specific services or tools. If you use any new features or tools we add to the platform in the future, those features will also be governed by these terms.
We recommend that you read these Terms of Service carefully and check back for updates. By continuing to use Fortiffi, you acknowledge and accept these terms.
1. Account Registration and Responsibilities
Overview:
By registering for a Fortiffi account, you acknowledge that you are responsible for maintaining your account, securing your login credentials, and ensuring that all materials you upload or share through the platform comply with our policies and applicable laws. If you violate any of the terms outlined in this agreement, we reserve the right to suspend or terminate your account.
Registration:
To access and use Fortiffi’s platform and services, you must create a Fortiffi Account. During the registration process, you will be required to provide certain personal or business information, including but not limited to your full legal name, business name (if applicable), contact details, valid email address, and any other necessary data. Fortiffi may reject or cancel your registration at our discretion for any reason.
Eligibility:
You must be at least 18 years old, or meet the legal age requirements in your jurisdiction, to create an account with Fortiffi. You agree that you are using our platform for legitimate business purposes only, not for personal, household, or family use.
Primary Communication:
You agree to provide and maintain a Primary Email Address for communication with Fortiffi. This email address will be used for all account-related communications, including updates, notifications, and customer support inquiries. You are responsible for ensuring that this email account remains active and accessible for receiving messages from Fortiffi.
Account Security:
You are responsible for safeguarding your account credentials, including your username and password. Fortiffi is not liable for any unauthorized access or loss of data resulting from your failure to secure your account. We may request additional security measures at any time, and you agree to comply with any updates or requirements.
Use Restrictions:
You agree not to:

Reproduce, duplicate, copy, sell, resell, or exploit any part of Fortiffi’s platform or services without prior written consent from Fortiffi.

Attempt to bypass or circumvent any of Fortiffi’s technical limitations or access controls.

Use any automated methods, such as robots, scrapers, or spiders, to collect or monitor data from the platform.
Materials Ownership and Usage:
“Materials” refers to all content you provide to Fortiffi, including but not limited to product listings, images, descriptions, videos, trademarks, logos, and other business information. By uploading materials to Fortiffi, you grant us a non-exclusive, royalty-free license to use, display, and distribute this content solely for the purpose of delivering the platform’s services and enhancing your business visibility.
Fortiffi may use your materials in a non-intrusive manner to help promote or optimize the platform’s services, including displaying product images or other content in related search results or marketing efforts, but all ownership of your materials remains yours.
Technical Support:
Support for your account and use of the Fortiffi platform is available to registered users. For questions related to these terms or to request assistance, you may contact Fortiffi’s support team through the contact information provided within your account.
2. Account Activation and Setup
2.1 Account Ownership:
When you register for Fortiffi, you will designate an Account Owner (usually the person creating the account). The Account Owner is responsible for managing all aspects of the account, including maintaining proper security, managing user roles, and ensuring compliance with the terms of this agreement. If you are creating an account on behalf of your organization, your organization will be considered the Account Owner, and you must use a valid email address tied to your business or employer.
Each account is associated with one Account Owner; however, an Account Owner can manage multiple storefronts, service offerings, or business locations. You agree to use Fortiffi’s checkout system for transactions related to your storefronts and to follow any further guidelines we may provide.
2.2 User Roles and Permissions:
Fortiffi allows the creation of multiple Staff Accounts under the primary Account Owner. You may assign different permission levels to each staff member based on their roles within your business. This allows for flexibility in who can access business data, manage inventory, process orders, or adjust settings in the platform.
The Account Owner remains fully responsible for ensuring that all staff members comply with Fortiffi’s Terms of Service. This includes, but is not limited to, maintaining appropriate security measures, handling transactions, and meeting legal obligations.
2.3 Payment Gateways and Third-Party Services:
Fortiffi integrates with several payment processors to help streamline your transactions. Upon account activation, Fortiffi will set up payment gateways for you, such as PayPal, Stripe, Apple Pay, Google Pay, and others. You are responsible for activating and managing these payment gateways, ensuring that they comply with all applicable payment terms, including updating payment settings or deactivating services as needed.
By using these services, you agree to the specific terms and conditions of each third-party service provider. You may modify your settings within the Payment section of your account to activate, deactivate, or switch payment methods.
2.4 Optional Payment Methods:
In addition to standard payment methods, Fortiffi offers alternative payment options that can be enabled or disabled based on your preferences. Other accelerated checkout options may appear by default once you set up your account. You have the ability to disable these methods at any time from your account settings if they do not suit your business model.
2.5 Domain Management:
If you choose to purchase a domain through Fortiffi, we will manage domain registration and ensure it automatically renews each year, so long as your account is active. Should you choose not to renew or wish to deactivate your domain, you may adjust these settings directly in your account. All domain-related purchases and configurations are handled through Fortiffi, with clear instructions provided for managing your domain settings.
2.6 Account Termination:
You have the right to terminate your account at any time by contacting Fortiffi’s support team and following the process outlined in our Account Management section. Upon termination, your data may be retained as per our Data Retention Policy and you will receive a final invoice for any outstanding balances.
3. Fortiffi Rights
3.1 Access and Control
Fortiffi retains the right to control who has access to its services and features. We reserve the ability to modify, suspend, or discontinue any part of our platform at any time, for any reason. We also reserve the right to refuse or remove any content or materials, including user-uploaded content, that violate our policies or terms.
3.2 Service Availability
Our services include a variety of features, and not all features will be available to every user at all times. Fortiffi is not obligated to offer any particular feature in every region or jurisdiction. We reserve the right to modify or discontinue services at any time, with or without notice.
3.3 Content Management
While Fortiffi does not pre-screen user-uploaded content, we reserve the right to refuse or remove any materials that violate our Acceptable Use Policy (AUP) or the terms of service. If we determine that your content or services are in violation of our policies, we may remove them without prior notice.
3.4 Conduct and Abuse
Any form of verbal or written abuse, including threats of abuse or retribution, directed at Fortiffi employees, contractors, or other users will result in the immediate termination of your account. We expect all users to communicate respectfully and professionally at all times.
3.5 Competitor Services
Fortiffi reserves the right to provide its services to competitors within the same industry. We make no promise of exclusivity, and there is no restriction on providing services to other entities in the same space. However, we guarantee that your confidential business data and information will not be shared with competitors.
3.6 Ownership Disputes
In the event of a dispute regarding account ownership, Fortiffi reserves the right to request documentation to verify and determine the rightful owner. Documentation may include, but is not limited to, a scanned copy of your business license, government-issued photo ID, or confirmation of your status as an employee of the business. If we are unable to determine the rightful account owner, Fortiffi may temporarily suspend or restrict access to the account until a resolution is reached.
3.7 Suspension or Termination
Fortiffi reserves the right to suspend or terminate an account at its sole discretion if we are unable to determine the rightful owner or if we believe that a violation of our Terms of Service has occurred. Suspended accounts may be restored once the dispute is resolved and ownership is verified.
4. Your Responsibilities
4.1 Account and Content Management
You are solely responsible for managing your account, your storefront, and the goods or services you offer through our platform. You must ensure that all materials, products, and services provided comply with our terms, policies, and applicable laws. You agree to provide accurate and up-to-date contact information, including email addresses and business details, and to maintain transparency regarding your refund policies and order fulfillment timelines.
4.2 Transactions and Customer Relations
You acknowledge that the platform is not a marketplace, and all transactions, including sales and services offered through your account, are directly between you and your customers. You are the seller of record for any products or services sold and are responsible for all aspects of the transaction, including payment authorization, refunds, returns, customer service, and the handling of disputes. This responsibility extends to any issues related to fraudulent transactions, required legal disclosures, and compliance with applicable laws.
4.3 Legal Compliance and Accuracy
You are responsible for ensuring that your storefront, your materials, and the goods or services you sell through the platform are truthful, accurate, and do not infringe on any intellectual property rights or violate applicable laws and regulations. This includes complying with any local, state, or international laws governing sales, advertising, and promotions. You also agree to handle all legal requirements related to taxes, shipping, customer service, and product guarantees within your jurisdiction.
4.4 Prohibited Use and Legal Violations
You are prohibited from using our platform for any illegal, unethical, or unauthorized activities. This includes, but is not limited to, using our platform to infringe upon copyright, trademark, or intellectual property laws, violate consumer protection laws, or engage in fraudulent practices. You agree to comply with all relevant laws and obtain any necessary licenses or permits required to operate your business through our platform.
4.5 Security and API Use
If you use our API or any third-party integrations, you are solely responsible for maintaining the security of your API credentials and any associated data. You agree to follow all best practices for securing your account and data, and to notify us immediately if you believe there has been a breach of security. You are responsible for any activity that occurs under your API credentials and for ensuring that any third-party applications or services you connect with the platform comply with all legal and security requirements.
4.6 Payment Processing
All payments for transactions made through your storefront will be processed through Fortiffi’s payment gateway. Once the funds are processed, they will be divided and allocated according to the agreed-upon terms. You are responsible for ensuring that all transactions comply with applicable laws and regulations. Any disputes or issues regarding the division of funds will be handled in accordance with the payment processing terms set by Fortiffi.
5. Payment of Fees and Taxes
5.1 Payment Methods and Subscription Fees
All accounts within the platform must maintain a valid payment method on file. This payment method will be used for the payment of all subscription fees and any additional service fees associated with your account. Subscription fees are billed monthly based on the number of products/services listed and the number of contractors managed within your account. The platform operates on a tiered subscription model that adjusts fees based on these factors, with specific pricing outlined below.

*If a customer is not associated with another Affiliate, Fortiffi is the EverLinked Affiliate and receives the full 6%.
5.2 Sub-Affiliate Accounts
Sub-Affiliates follow the same pricing model as Affiliates, calculated independently based on their own number of users. Sub-Affiliates are not eligible for shared pricing with their parent Affiliate account. Affiliate accounts have the ability to determine how payments for their Sub-Affiliates’ subscriptions, accounts receivable (AR), and accounts payable (AP) are handled.
5.3 Subscription Fee Adjustments
Subscription fees are subject to change. If there are adjustments to the pricing, you will be notified 30 days in advance. Each month, your subscription fees will automatically adjust based on the current number of active product/service listings and contractors in your account. Any changes will be reflected in the upcoming billing cycle.
5.4 Additional Fees and Optional Services
In addition to subscription fees, you may incur additional charges for extra services such as:

Additional product or service listings beyond your plan’s limit.

The creation of Sub-Affiliate accounts.

Future premium tools, such as marketing, analytics, or sales automation features, which will be offered as add-ons.
These additional fees are charged as applicable, and the total amount will be included in your monthly invoice.
5.5 Contractor Subscription Fees
Contractors are not required to pay subscription fees unless they upgrade to an Affiliate account. Contractors who wish to list their own products or services must subscribe to an Affiliate plan and pay the applicable monthly subscription fee.
5.6 Service Fees
Fortiffi charges a service fee of 3% on all pre-tax gross sales conducted through your account. This fee is calculated before revenue is distributed to Affiliates and Contractors.
5.7 Payment Processing and Revenue Distribution
All funds from transactions processed within the platform are routed through the Fortiffi payment gateway. After the necessary service fees are deducted, the remaining funds are distributed to the Affiliates and Contractors involved in the transaction based on the applicable revenue-sharing structure. Payments to contractors will be processed once approved for payroll, and affiliate commissions are tracked according to the terms set for each transaction.
5.8 Taxes
You are solely responsible for any taxes that arise from your use of the platform or from the sale of products and services through your storefront. This includes local, state, federal, and other applicable taxes. If taxes are not directly collected by Fortiffi, it is your responsibility to determine and remit these taxes to the relevant authorities.
5.9 Refunds and Deductions
All fees paid to the platform are non-refundable. If you have questions about your billing or need to address any discrepancies, you must do so within two weeks of receiving the invoice. We reserve the right to waive any fee at our discretion, particularly in cases of pilot programs, beta users, or special discounts. If fees are deducted for any reason, they will be clearly outlined in your monthly invoice.
5.10 Account Suspension and Termination
If payment for any fees is unsuccessful within 28 days of the initial payment attempt, your account may be suspended. Services will be restored once payment has been processed. If payment remains outstanding for 60 days, your account may be terminated, and you will lose access to your storefront and services.
5.11 Billing and Invoices
All fees will appear on an invoice, which will be sent to the primary email address on file. Invoices will also be available on the administrative console of your account. You must ensure that your payment method and tax information are current and correct to avoid service interruptions.
5.12 Pricing Transparency
All pricing will be provided clearly, including the details of any applicable service fees, taxes, or additional charges. You can view and manage your subscription and billing preferences in your account settings.
6. Confidentiality
6.1 Confidential Information
Both you and Fortiffi agree to use each other’s Confidential Information solely for the purpose of fulfilling the obligations outlined in these Terms of Service. Confidential Information must be safeguarded and handled with the utmost care and respect.
“Confidential Information” includes, but is not limited to, any and all information related to a party’s business that is not publicly available. This encompasses business processes, proprietary software, customer and prospective customer lists, pricing structures, financial information, marketing strategies, business plans, product designs, and any other sensitive business data. Confidential Information also includes any details related to security measures, proprietary technology, and systems related to the Services provided by Fortiffi.
6.2 Use of Confidential Information
Each party agrees to use the Confidential Information of the other party exclusively for fulfilling its obligations under these Terms of Service. This includes taking reasonable steps, no less stringent than those used to protect its own confidential information, to prevent unauthorized access, duplication, or use of Confidential Information. Confidential Information may only be disclosed to employees, agents, or subcontractors who require access to such information to fulfill their responsibilities, and these individuals must be bound by confidentiality agreements that provide at least the same level of protection as these Terms of Service.
6.3 Exceptions to Confidentiality
Confidential Information does not include any information that the receiving party can prove:

(A) Was publicly available at the time of disclosure, or became publicly available through no fault of the receiving party;
-
(B) Was known to the receiving party before it was disclosed, as evidenced by written records or other proof;
-
(C) Was independently developed by the receiving party without reference to or use of the disclosing party’s Confidential Information, and without violating any provisions of these Terms of Service; or
-
(D) Was obtained from a third party, without violation of any confidentiality obligation, and that third party had the legal right to provide such information.
6.4 Disclosure of Confidential Information
If required by law, regulation, or court order, a party may disclose Confidential Information. However, the receiving party agrees to notify the disclosing party promptly, to the extent permitted by law, and to use commercially reasonable efforts to ensure that any disclosure is treated as confidential to the extent possible.
6.5 Return or Destruction of Confidential Information
Upon termination of these Terms of Service, or at the request of the disclosing party, the receiving party agrees to return or destroy all Confidential Information in its possession, except for any information that must be retained in order to comply with legal obligations.
7. Limitation of Liability and Indemnification
7.1 Limitation of Liability
You acknowledge and agree that, to the extent permitted by applicable law, Fortiffi and its suppliers shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising from or relating to the use of, or inability to use, the Services or these Terms of Service. This limitation applies regardless of the cause of action, whether based in contract, tort, negligence, or any other legal theory, even if Fortiffi has been advised of the possibility of such damages.
7.2 Indemnification
You agree to indemnify, defend, and hold harmless Fortiffi, its subsidiaries, affiliates, officers, directors, employees, agents, and suppliers from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

(a) Your breach of these Terms of Service or any documents incorporated by reference, including the Acceptable Use Policy (AUP);
-
(b) Your violation of any law, regulation, or the rights of a third party;
-
(c) Any aspect of the transaction between you and your customer, including but not limited to refunds, chargebacks, fraudulent transactions, consumer protection law violations, or any other breach of applicable laws;
-
(d) Any use or misuse of the Services by you or any individual or entity acting on your behalf, including contractors or affiliates.
You will also be responsible for any breach of these Terms of Service caused by your affiliates, agents, subcontractors, or any other third party acting under your direction, and will be held liable as though the breach was committed by you directly.
7.3 No Warranty
The Services are provided on an “as is” and “as available” basis without any warranties, express, implied, or statutory. Fortiffi does not warrant that:

The Services will be uninterrupted, timely, secure, or error-free;
-
The results obtained from using the Services will be accurate or reliable;
-
The quality of any products, services, or other materials purchased or obtained through the Services will meet your expectations; or
-
Any errors in the Services will be corrected.
7.4 Tax Responsibilities
Fortiffi is not responsible for any of your tax obligations or liabilities arising from your use of the Services. You are solely responsible for ensuring compliance with all applicable tax laws and regulations in your jurisdiction, including, but not limited to, sales tax, income tax, and any other taxes associated with transactions made via the Services.
7.5 Exclusions of Liability
Under no circumstances shall Fortiffi’s liability exceed the total amount of fees paid by you for the Services in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies to all claims related to the Services, regardless of the legal theory under which such claims are made.
8. Intellectual Property and Your Materials
8.1 Your Materials
You retain ownership of all the materials you upload to the platform, provided that you hold the necessary rights to them. By using the Services, you grant Fortiffi a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and license to host, use, distribute, modify, publicly display, reproduce, store, and perform your materials as necessary to operate, promote, and provide the Services. This license is granted for the purpose of fulfilling our obligations and exercising our rights under these Terms of Service.
You represent and warrant that you own or have the rights to use the materials you upload, and you have the authority to grant the license mentioned above. You further agree to waive any moral rights to the materials to the extent permitted by law, in favor of Fortiffi and any authorized parties, including affiliates, licensees, or assignees.
While you retain ownership of your materials, Fortiffi requires the rights granted in this section to operate and promote the Services effectively. You may remove your materials from the platform at any time by deleting your account; however, any licenses granted to Fortiffi remain in effect for any rights or obligations that arose during your usage of the Services.
Fortiffi reserves the right to review and remove any materials submitted through the Services, though we are not obligated to do so.
Additionally, you grant Fortiffi a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and license to use your store’s name, logo, trademarks, and service marks (“Your Trademarks”) to operate, provide, and promote the Services. This license will remain in effect even after the termination of these Terms of Service as necessary for Fortiffi to continue fulfilling its rights or obligations from the term of the agreement.
8.2 Fortiffi Intellectual Property
You agree that you may not use Fortiffi’s trademarks, logos, or service marks, including but not limited to any word marks or designs associated with Fortiffi, unless explicitly authorized by us in writing. You agree not to adopt or use any marks that may be confusingly similar to Fortiffi’s trademarks.
You are prohibited from purchasing, registering, or using any search engine keywords, domain names, social media handles, email addresses, or other digital identifiers that use or include the Fortiffi brand or any confusingly similar variations of our trademarks, including misspellings or similar terms.
These Terms of Service do not grant you any rights to use Fortiffi’s patents, trademarks, or other intellectual property beyond the scope of this agreement.
9. Additional Services
9.1 POS Services
If you opt to use our Point-of-Sale (POS) Services, which may be available in the future, you are required to use the same payment processor for both online and in-person transactions. The POS Services are flexible, allowing you to cancel at any time without affecting other active services, including online services. However, while we prioritize data security, we cannot guarantee the security of every transmission using the POS Equipment. All transactions conducted via POS Equipment are at your own risk. Please note that the POS Equipment is purchased, not leased, and is subject to the return policy (excluding Chip & Swipe Reader, Audio Jack Swipe, and physical gift cards).
The POS Services include software, hardware, tools, and updates provided to you by us. Accessing the POS Services requires an active and valid account with us. If your POS Services are linked with a payment processor, you are restricted from using other payment processing services. The payment gateway for POS transactions must match that used for your online transactions.
You can cancel your POS Services without terminating your entire account. Fees related to POS Services will be based on the number of locations, defined by business addresses, and billed accordingly. If there is a discrepancy between the locations added manually and those detected by our system, the number detected by us will be considered correct.
9.2 Shipping Services
If you use our Shipping Services, you must comply with the relevant shipping terms provided. You can purchase shipping labels from your administrative console for orders placed through your store. Access to shipping services is also subject to specific terms that are provided based on your location (US, Canada, or global).
9.3 SMS Messaging
By using our SMS Services, you agree to comply with applicable laws, and acceptable use policies set forth by third-party SMS providers such as Nexmo and Twilio. You must ensure all messaging complies with both the law and the service’s terms, including privacy regulations, and not misuse the service for unsolicited commercial messaging.
9.4 Theme Store
You may in the future be able to purchase themes for your store from the Theme Store and modify them as needed for your business. However, themes are licensed for use on one store at a time, and transferring or selling themes is prohibited. If you need a theme for a second store, you must download it again, and each new download will incur a charge. Shopify may modify the theme or footer as needed, and technical support for themes is provided by the designer, not us.
9.5 Email Services
Using our Email Services means you agree to certain monitoring procedures, including content scanning, to ensure compliance with policies. You are responsible for ensuring all content complies with applicable laws. Additionally, you should avoid sending sensitive personal data through the service. You must adhere to Shopify’s guidelines for email communication, including obtaining explicit opt-ins from recipients and providing clear options for them to unsubscribe.
9.6 App Integration
Our platform offers the option for integrating third-party applications (such as Google Maps, etc.). You agree to use these services at your own risk and ensure that you have the necessary rights to any data shared with third parties. Shopify is not responsible for any issues arising from third-party integrations or disputes.
9.7 Third Party Services, Experts, and Marketplace
We may introduce third-party services, experts, or platforms through our service. Using these third-party services is at your own discretion, and you must review their terms before proceeding. Shopify is not responsible for any issues related to third-party services, and your relationship with such providers is independent of our responsibilities.
9.8 Beta Services
From time to time, we may offer Beta Services that are experimental or in pre-release stages. These services come with no guarantees and are provided “as-is.” You use them at your own risk, and we are not liable for any issues that arise while using these Beta services. Participation in Beta Services may require confidentiality agreements and could be discontinued at any time.
9.9 Analytics and Tracking Tools
We provide tools like the Pixel Manager for tracking customer activities on your store. If you use such tools, you are responsible for obtaining the necessary consents from customers whose data you track, and you must comply with relevant data protection laws. Shopify has the right to disable tracking tools that it deems harmful or non-compliant with our policies.
10. Feedback and Reviews
We appreciate ideas, suggestions, and reviews from our users, but submitting feedback does not create any obligation on Fortiffi’s part—legal, financial, or otherwise.
By submitting any comments, suggestions, feature ideas, or related content (“Feedback”) to Fortiffi—whether through our platform, support channels, forums, or affiliated pages—you agree that:

Fortiffi is under no obligation to keep the Feedback confidential.

Fortiffi may use, reproduce, modify, or implement the Feedback in any way, with or without attribution.

You waive any right to compensation or recognition for the use of your Feedback.

You grant Fortiffi a perpetual, royalty-free, worldwide, irrevocable license to use and incorporate your Feedback into the platform or its services.
If you submit reviews about third-party services or other users on the platform, those reviews must be accurate, lawful, and free from any defamatory, abusive, or infringing content. Fortiffi reserves the right—but not the obligation—to moderate, remove, or edit such content at its sole discretion. However, we do not monitor all user-submitted content and assume no responsibility for it.
11. DMCA Notice and Takedown Procedure
Fortiffi respects the intellectual property rights of others and expects users of our platform to do the same.
If you believe that content hosted on Fortiffi infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) Notice to our designated agent. Upon receiving a valid DMCA notice, we may promptly remove or disable access to the allegedly infringing material and notify the account holder responsible.
If you are a Fortiffi user and believe that content was removed in error or misidentification, you may respond with a counter notification. Upon receiving a valid counter notification, we may restore the content unless the original complainant files a legal action within 14 business days.
To submit a DMCA notice or counter-notice, you must provide all information required under the DMCA. Incomplete or inaccurate submissions may not receive a response.
Fortiffi reserves the right to suspend or terminate accounts that repeatedly infringe on the intellectual property rights of others.
13. Privacy and Data Protection
Fortiffi is committed to protecting the privacy and security of personal information—both yours and your customers’.
By using Fortiffi, you acknowledge and agree that any collection, use, or disclosure of personal information is subject to our Privacy Policy, which outlines how we gather, store, and manage data across our platform.
To the extent Fortiffi processes customer personal information on your behalf as a “data processor” or “service provider” under applicable data protection laws—including the EU and UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA)—such processing is also governed by our
Data Processing Addendum.
You are responsible for ensuring that your own use of Fortiffi, and any data you collect from your customers through the platform, complies with all applicable privacy and data protection laws in your jurisdiction.

14. Term and Termination
These Terms of Service begin on the date you complete registration for a Fortiffi account and remain in effect until terminated by either party in accordance with the terms below (the “Term”).
All Fortiffi subscriptions require a minimum 12-month commitment and are billed annually. Subscriptions automatically renew each year unless canceled in accordance with this section.
You may request termination of your account by contacting Fortiffi Support. Termination requests must be submitted at least 30 days prior to your annual renewal date to avoid renewal charges. Terminations made after renewal will not result in a refund, and your account will remain active until the end of the current billing cycle.
Fortiffi may suspend or terminate your account at any time, with or without notice, for reasons including but not limited to suspected fraud, misuse of the platform, or violation of these Terms.
Upon termination:

Fortiffi will stop providing services associated with your account.

You will lose access to your account and its associated data.

Any unpaid balance becomes immediately due and payable.

No refunds will be issued for any portion of the subscription term.
If you registered a domain or activated a white-labeled app through Fortiffi, it is your responsibility to manage renewals or transfers directly with the relevant provider after termination.
You will receive a final invoice for any outstanding fees at the time of termination. Once paid, no further billing will occur.
15. Modifications
Fortiffi reserves the right to update, modify, or amend these Terms of Service at any time and in its sole discretion.
If we make changes that materially impact your rights or the way you use our Services, we will provide advance notice by email, through your Fortiffi dashboard, or by other reasonable means. However, certain changes may take effect immediately without notice if required to comply with legal obligations, address security concerns, or prevent abuse of the platform.
Unless otherwise specified in our notice, all updates will become effective upon being posted to our website. Your continued use of Fortiffi after any such changes constitutes your acceptance of the updated Terms. If you do not agree to the amended Terms of Service, you must stop using the platform and may request to terminate your account in accordance with Section 14.
Fortiffi may also update its pricing structure from time to time. In the event of a change to subscription or service fees, you will receive at least 30 days’ notice prior to the effective date of the new pricing.
We are not liable to you or to any third party for any modification, price change, suspension, or discontinuation of the Services or any part thereof.
16. General Conditions
These Terms of Service, along with any documents or policies referenced herein, constitute the entire agreement between you and Fortiffi regarding your use of the Services and your account. They supersede any prior agreements or understandings—oral or written—related to the Services.
Fortiffi’s failure to exercise or enforce any right or provision in these Terms does not constitute a waiver of that right or provision. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, it will be modified to the minimum extent necessary to make it enforceable while preserving its original intent. All remaining provisions will remain in full force and effect.
Unless otherwise stated, no individual or entity that is not a party to these Terms will have any rights to enforce them. This does not affect the rights of any permitted assignees or transferees.
These Terms are governed by and interpreted in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. Any disputes will be resolved exclusively in the courts located in Jefferson County, Alabama, unless otherwise required by law.
Fortiffi may assign or transfer these Terms of Service without notice or consent. You may not assign or transfer your rights or obligations under these Terms without Fortiffi’s prior written consent.
If these Terms are provided in multiple languages, the English version will govern in the event of any conflict or inconsistency.
Upon termination of your account, all rights and obligations under these Terms will cease, except that the following sections will survive termination:
Section 1 (Account Terms), Section 5 (Payment of Fees), Section 6 (Confidentiality), Section 7 (Limitation of Liability and Indemnification), Section 8 (Intellectual Property), Section 10 (Feedback and Reviews), Section 12 (Privacy and Data Protection), Section 14 (Term and Termination), Section 15 (Modifications), and Section 16 (General Conditions).
You remain responsible for any obligations or liabilities incurred prior to or resulting from termination.
